ORDER : 1. Heard the learned counsel appearing for the parties. 2. Even though notice was issued in the matter on 2-9-2019, no counter affidavits/documents are filed by the States except (i) Union Territory of Andaman & Nicobar, (ii) States of Punjab, (iii) Karnataka, (iv) Uttarakhand, (v) Jharkhand, (vi) Nagaland and (vii) Union Territory of Jammu & Kashmir. 3. It is unfortunate to note that even after lapse of considerable period of time, there is no proper response from the State Governments. 4. In view of the above, we impose costs of Rs.5,00,000/-(Rupees Five Lakhs only) on each State and Union Territory for not filing counter affidavits in the matter. 5. We are informed by some of the learned counsel appearing for the States/Union Territories that they are ready with their counter affidavits. 6. In view of the above, those States/Union Territories counsel, who file their counter affidavits by tomorrow evening, shall have to pay a costs of Rs.1,00,000/-(Rupees One Lakh Only) and rest of the States/Union Territories shall have to pay a costs of Rs.5,00,000/- as stated here-in-above and one weeks’ time is granted to them for the purpose. 7. The costs shall be deposited with the Registrar (Judl.) of this Court who shall keep the same in a separate head. 8. List the matter on Monday, the 17th February, 2020.
