JUDGMENT 1. Petitioner has undertaken a job of Deep Drilling, Development and stabilization of Tube well by direct rotary method at village Matkani, Bari Khad, in Vijaypur Constituency, District Samba (J&K). The work executed by the petitioner is strictly in terms of allotment letter and the bills stand duly verified by the Jr. Engineer, Assistant Engineer and Assistant Executive Engineer. 2. Since the work was executed in entirety, petitioner has approached the respondents time and again for payment, but till date the same has not been received in his favour. The Executive Engineer PHE Mechanical GWD Division, Jammu, i.e., respondent No. 4 vide its communication dated 23.10.2019 was requested the Chief Engineer-respondent No. 2 for allotment of the amount for clearance of the liability in favour of the petitioner. 3. Learned counsel for the petitioner submits that he will be satisfied if this petition is disposed of at this stage itself with a direction to the respondents to consider the case of the petitioner for release of the admitted amount. 4. In view of the above, this petition, at the threshold, is disposed of with a direction to the respondents to consider the case of the petitioner for release of the admitted amount provided there is no legal or contractual impediment. Let a decision be taken within two months from today. 5. Connected application also stands disposed of, accordingly.
