JUDGMENT Rajeev Kumar Shrivastava, J. - The instant petition in the nature of Public Interest Litigation under Article 226 of the Constitution of India has been filed for issuing writ of mandamus/prohibition to protect uncountable fruits bearing trees standing on the land bearing survey No. 438/2 area 2.717 hectares, situated in village Daboh, which are being proposed to be cut/fell down for the purpose of establishing proposed Upmandi Krishi Upaj at Daboh. 2. The facts in short are that on land bearing survey No. 438/2 area 2.717 hectare, situated at Daboh Alampur, Tahsil Lahar, District Bhind, uncountable fruits bearing and other green trees are standing. Earlier there was a civil dispute about ownership of land between the private party with Krishi Upaj Mandi Samiti Alampur, which went up to this Court in Second Appeal No. 212/1996. The said appeal was decided in terms of compromise, according to which Krishi Upaj Mandi Samiti Alampur has got the land bearing survey No. 438/2 area 2.717 hectare. Hence, Krishi Upaj Mandi Samiti Alampur has become owner of said land. Now Krishi Upaj Mandi Samiti has proposed to establish Upmandi, for which the Director Mandi has also sanctioned Rs. 30.00 Lacs and in furtherance of the said object Krishi Upaj Mandi Samiti has invited tenders to construct the boundary wall over the area, however the fact remains that at present more than 2500 fruit bearing trees of Aam, Kathal, Awala, Amrood, Kadam, Sisam, Beri, Chhola, Anar, Mahua, Pipal, Labera, Khirani and other trees are standing on the land in question, over which Upmandi cannot be established. 3. The contention of learned counsel for the petitioner is that Article 48A of the Constitution casts duty on the State to protect and improve the environment and safeguard the forest and wild life because the trees are the source for good environment. The respondent authorities have forgotten their constitutional duty and are making notorious plan to cut down the full grown green trees. Every person has fundamental right to life and liberty guaranteed under Article 21 of the Constitution and right to life includes enjoying healthy environment but the authorities are hell-bent upon to destroying the existing natural resource which would adversely affect the ecological balance causing irreparable and irreversible loss to nation. 4.

It has further been contended that vide notice dated 19.8.2016 the respondent No.11 has called Notice Inviting Tender (NIT) for construction of main gate, boundary wall, check post at Alampur and trolley shed, office building at Upmandi Daboh on the land in question. The need of the hour is to have as many trees as possible and endeavour of government as well as public ought to be to plant more and more trees rather than to cut down healthy full grown trees. Section 240 of MP Land Revenue Code 1959 and rules framed thereunder prohibits cutting of fruit bearing trees particularly green trees from the government land but in the case in hand the respondent authorities are trying to cut down green trees. Hence, interference is sought for from this Court by quashing NIT dated 23.6.2016 (Annexure P/1) and Tender Notice dated 19.8.2016 (Annexure P/1A). 5. The respondent-State Authorities in their reply have submitted that the authorities are not doing any act of cutting trees as the land in question is in the ownership of Krishi Upaj Mandi Samiti. Respondent-M.P. Pollution Control Board in its reply has submitted that the petitioner has not sought any relief against MP Pollution Control Board. In reply, Krishi Upaj Mandi Samiti has submitted that the present PIL is wholly misconceived and devoid of merits for the reason firstly that no trees have been cut by the respondent either for the purpose of construction and development of Upmandi at Daboh or for any other purpose and secondly, the petitioner has not filed any documents to indicate that over the land in dispute any trees or fruit bearing trees are standing and the respondents have ever attempted to cut down any such trees. The aforequoted annexure is a letter issued by the-then Executive Engineer, Madhya Pradesh Rajya Krishi Vipdan Board, Technical Division, Jiwajiganj, Morena to Secretary/President, Krishi Upaj Mandi Samiti Alampur, District Bhind, wherefrom it is apparent that one Krishna Gopal has been encroaching the land in question and he had unauthorisedly planted trees on the aforesaid land with oblique motive to cause hindrance in establishing Upmandi, Krishi Upaj at Daboh. 9. Attention is drawn to the Court order dated 18.12.2017. As per the said order, total 929 trees are situated over survey No. 438/2, which is undisputedly owned by Krishi Upaj Mandi, and all the trees are useful. Mandi is basically meant for the farmers who come from different distant places. If such trees continue to stand over the area in question, it will become a more useful place for establishing Upmandi Krishi Upaj at Daboh because whenever farmers visit Upmandi, they will be benefited by the shade as well as available fruits. 10. Therefore, keeping in mind over all situation, it would be in the interest of public at large if Upmandi is established at Daboh over the land in question, i.e., survey No. 438/2, without cutting the trees standing over the land. In consequent thereto, we dispose of the present petition with the following directions:-- (i) At first stage, a boundary wall be constructed to protect the trees over the land bearing survey No. 438/2 area 2.717 hectare; (ii) Collector as well as Divisional Forest Officer of the concerned District are hereby directed to keep constant vigil over the land and ensure that not a single tree is cut for the purpose of establishing Upmandi Krishi Upaj at Daboh, failing which the Collector and the DFO Bhind shall expose themselves to disciplinary penal action; (iii) It is also expected from the authorities proposing to establish Upmandi that prior to commencement of construction they will prepare site plan, landscaping and spot map for Upmandi; (iv) Collector as well as Divisional Forest Officer of the concerned District are hereby directed to ensure compliance of the aforementioned direction by personally inspecting the location and ensure that the construction work is carried out after lawful approval without cutting any tree; (v) It is made clear that if any bush/bushes are required to be removed from the said land, the Mandi Authorities will get prior approval of the Collector/DFO concerned. 11.
