ORDER Heard learned counsel for the petitioner and State as well as informant. 2. The petitioner is in custody, on remand, in connection with Ekma P.S. Case No. 273 of 2019 for the offence under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. 3. Learned counsel for the petitioner submits that the petitioner has been made accused in this case only on the basis of suspicion that he was a king pin in the commission of crime, while he was inside the jail. The petitioner is in custody since 24.10.2019. He further submits that admittedly the petitioner was not involved in the commission of crime and his name figured only because the co-accused whispered that he has accomplished the job at the instance of this petitioner, who was in jail custody. 4. Mr. Bindhyachal Singh, learned counsel for the informant submits that the materials have surfaced to suggest that the petitioner has played a key role in the commission of crime, while he was in jail custody. He further submits that in order to pressurize the informant’s side, the petitioner has exerted pressure tactics and, as such, he does not deserve bail. 5. Considering the fact that the petitioner is only suspected in the commission of crime and his role is as a conspirator, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-I, Saran, Chapra in connection with Ekma P.S. Case No. 273 of 2019 with the following conditions: – (i) The bailors should be the family members. (ii) In the event, the petitioner is found involved in terrorizing or influencing the witnesses, the Court below shall be at liberty to cancel his bail bonds. In addition thereto, the petitioner has to tender his service as a volunteer for a period of three months from the date of his release in the process of combating Corona virus. The petitioner is required to report the Civil Surgeon, Saran at Chapra on his release so that his services may be utilized by the Civil Surgeon, Saran at Chapra in the process of combating Corona virus.
