ORDER : K. Vijaya Lakshmi, J. 1. This contempt case is filed alleging disobedience of the orders dated 1.7.2019 passed by this Court in WP No. 467 of 2019, wherein, the said writ petition was disposed of, directing the 4th respondent to follow due process of law by issuing notice to all the concerned and take appropriate action in accordance with law. 2. WP No. 467 of 2019 was filed to declare the action of the respondent-authorities in not initiating sub-division in respect of lands in Sy. No. 1/7 situated at Garlapadu Village, Laxminarsupeta Mandal, Srikakulam District, pursuant to online application dated 6.9.2017, as illegal and arbitrary. 3. When the said writ petition came up for admission, written instructions were submitted by the learned Assistant Government Pleader for Revenue, stating that sub-division records are under preparation. In view of the said instructions, the Tahsildar was directed to follow due process of law by issuing notice to the concerned and to take appropriate action in accordance with law. 4. Alleging disobedience, the present contempt case is filed by the petitioners. Counter-affidavit is filed by the 3rd respondent-Tahsildar, stating inter alia, that a team with Mandal Revenue Inspector, Mandal Surveyor, Village Revenue Inspector of L.N. Peta Mandal alongwith the Sub-Inspector of Police, Sarubujjili PS visited the land in question on 26.7.2019 and on 22.10.2019 to comply with the directions of this Court dated 1.7.2019; 1st petitioner also attended the subject land; one Ariki Ramulu and other tribals, who were enjoying the subject land, obstructed to conduct sub division work with ETS survey and hence, all the officials alongwith the 1st petitioner returned without doing the same; a communication to that effect was also sent to all the petitioners vide letter in RC No. 293/2016 dated 22.11.2019 stating that as the subject lands are in occupation of the Tribals for the last many years, petitioners were asked to approach the competent civil Court and that in those circumstances sub division work could not take place. 5.

Reply-affidavit is filed by the petitioners stating inter-alia that the petitioners also filed OS No. 48 of 2019 before the Vacation Civil Judge (Principal Senior Civil Judge), Srikakulam and obtained interim direction against one A. Ramulu and others in IA No. 128 of 2019 dated 31.5.2019 and that the same was made absolute by the Additional Senior Civil Judge, Srikakulam in IA No. 244 of 2019 in OS No. 38/2019 dated 6.12.2019. 6. In the affidavit filed alongwith the writ petition, it is stated that the vendor of the petitioners i.e., Mr. A. Kesava Rao, who sold an extent of Acs. 10.62 cents vide Registered Sale Deed No. 1321 of 2016 to the petitioners, has obtained permanent injunction in OS No. 745 of 2012 on the file of the Principal Senior Civil Judge, Srikakulam and that thereafter, their vendor has been in possession and enjoyment of the same and that the petitioners have purchased the subject property from the said A. Kesava Rao. Nothing is stated in the writ affidavit as to whether the same has attained finality. Even though, averments in the writ affidavit shows that the total extent of Acs. 133.00 cents in Sy. No. 1/7 is private in nature, nowhere it is stated that they are in possession of the entire extent of land. Apart from all that, the respondents tried to comply with the order, but as some other persons, who are in possession of the subject land obstructed for sub-division of the property, they could not comply with the said order, which is neither willful nor wanton. A proceeding dated 22.11.2019 was also issued disposing of the online applications made by the petitioner. As seen from the counter-affidavit and reply-affidavit, there are civil disputes between the parties with regard to subject property. Hence, I am of the view that there is no willful disobedience of the order of the Court. 7. In view of the same, the contempt case is dismissed. No order as to costs. Miscellaneous petitions, if any, pending in this contempt case shall stand closed.
