ORDER 1. The challenge in this writ petition is to an order dated 25.10.2019 (Annexure-P-8) passed by the Director, Mines and Minerals Madhya Pradesh. 2. Learned counsel for the State raised a preliminary objection that the order impugned herein is appealable under rule 57 of the M.P. Minor Mineral Rules 1996. Chapter XIII of the said Rules provides for appeal, review and revision. Rule 57 thereunder deals with Appeal, Review and Revision, which is in the following terms : "57. Appeal, Review and Revision.-(1) [ x x x] (2) Where any power is exercisable by the Collector/Additional Collector/Of icer Incharge, Mining Section under these rules, in relation to any matter an appeal shall lie, from every order passed or deemed to have been passed under these rules to the Director. (3)Where any power is exercisable by the Director under these rules, in relation to any matter an appeal shall lie from every order passed or deemed to have been passed under these rules to the State Government. (4)Any person aggrieved by any order passed or deemed to have been passed by the State Government, in exercise of the powers conferred under these rules, may, within sixty days of the date of communication of the order to him, apply to the State Government for review of the order. (5)The State Government may at its own motion review any order passed by itself and pass such order in reference thereto as it thinks fit." 3. Under sub-rule (3) of rule 57 where any power is exercisable by the Director under these rules, in relation to any matter an appeal shall lie from every order passed or deemed to have been passed under these rules to the State Government. 4. Accordingly, the petition is disposed of by relegating the petitioner to avail the alternative remedy of approaching the State Government in accordance with law.
