JUDGMENT 1. By filing this petition under Section 439 of the CrPC , the accused/petitioner Jagat Das, who is facing the trial in connection with Session Case No.30/2019, arising out of Missamari P.S. Case No.193/2018, under Section 302 of the IPC , pending before the learned Sessions Judge, Sonitpur at Tezpur, from the date of arrest w.e.f. 27.11.2018, has prayed for releasing him on bail in connection with the said case. 2. Heard Mr. M.A. Islam, learned counsel for the petitioner as well as Mr. P.P. Baruah, learned P.P., Assam for the State respondent and perused the case record. 3. The present bail petition is preferred with the submission that the petitioner is suffering from mental disorder since long and almost all the witnesses have now been examined and hence the petitioner should be enlarged on bail. 4. Perused the documents annexed and considered the submission. 5. It appears that almost all the witnesses have been examined by the trial Court and the case is at the verge of conclusion of trial. So the trial Court is in a position to decide the entire matter. The plea regarding the mental disorder, it is to be raised before the trial Court but on examination of the evidence (the cross-examination etc.), it reflects that no any plea of mental disorder was taken before the trial Court and hence the said aspect has no role to play at this stage. 6. Taking note of entire matters on record, the bail petition stands disposed of with a direction to the trial Court to expedite the case and conclude the trial at the earliest, preferably within two months from today. The bail petition stands disposed of.
