JUDGMENT 1. By this application u/s 438 Cr.P.C. , the petitioners, namely, Mohammad Ali and Jabir Hussain @ Ahmed have prayed for pre-arrest bail apprehending arrest in connection with Karimganj P.S. Case No. 1250/2018 u/s 364-A/511/34 of the IPC. 2. Heard Mr. H.R. Choudhury, learned counsel for the petitioners and Mr. M.P. Goswami, learned Addl. Public Prosecutor for the State. Also perused the FIR and the documents annexed therewith as well as the case diary produced today. 3. Allegation made in the FIR was that the petitioners kidnapped the son of the informant and demanded Rs. 5 lacs from him and threatened to kill him if the demand is not fulfilled. 4. Case diary transpires that the statement of the victim has been recorded u/s 164 Cr.P.C., wherein the petitioners have been implicated. 5. Therefore, having regard to the nature of accusation and the materials in the case diary, this is not considered to be a fit case for extending the benefit of pre-arrest bail. Accordingly, the prayer for pre-arrest bail stands rejected. 6. Send down the case diary. AB stand disposed of.
