JUDGMENT G. Sri Devi, J. - This Criminal Petition under Section 438 of Cr.P.C. is filed by the petitioner/A2, seeking anticipatory bail in Crime No.940 of 2019 on the file of the S.H.O., Jawaharnagar Police Station, Rachakonda District, registered for the offences punishable under Sections 304-B IPC and 3 (2) (v) of SCS/STS (POA) Act, 2015. 2. Heard learned counsel for the petitioner as well as the learned Additional Public Prosecutor appearing for respondent-State. 3. Learned counsel for the petitioner submits that there are no specific allegations against the petitioner with regard to any harassment to the daughter of the de facto complainant. He further submits that the marriage of the daughter of de facto complainant with the son of the petitioner is a love marriage and the petitioner never interfered in any manner in the marital life of her son. The petitioner is no way concerned with the alleged offences. He further submits that the petitioner would co-operate with the investigation and she is ready to furnish sureties to the satisfaction of the Court if she is enlarged on anticipatory bail and hence, he prays to grant anticipatory bail to the petitioner. 4. On the other hand, the learned Additional Public Prosecutor representing the State vehemently opposed the bail application. 5. As seen from the contents of the F.I.R., it is clear that the marriage of the deceased-Mamatha (daughter of the de facto complainant) with A1 was solemnized, which is a love marriage, in the month of February, 2018. For the last one month, the petitioner and A1 started harassing the deceased demanding her to bring dowry of Rs. 5,00,000/-. On 20.12.2019 at about 11.00 hours, the petitioner and A1 harassed the deceased both physically and mentally. Due to the unbearable torture, the deceased committed suicide by hanging on 20.12.2019 at 21.30 hours at her residence. 6. Thus, looking into the nature of allegations made against the petitioner and also keeping in view the facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. 7. Accordingly, the Criminal Petition is dismissed. However, if the petitioner-A2 surrenders before the concerned Court within 15 days from today and files an application after giving due notice to the Public Prosecutor, the same may be considered in accordance with law. Miscellaneous petitions, if any pending, shall stand closed.
