JUDGMENT 1. This intra-court appeal is directed against the judgment dated 22 nd of November 2017 passed by learned Single Judge of this Court, whereby writ petition preferred by respondent/writ-petitioner assailing the order cancelling the Letter of Intent without notice, has been allowed. 2. As per office report, though the application under Section 5 of the Limitation Act is filed. The appeal is not accompanied by certified copy of the judgment impugned. 3. Mr. Sandeep Shah, learned Additional Advocate General submits that the judgment under appeal was passed by the learned Single Judge relying upon a judgment in M/s Karni Mines & Minerals Vs. State of Rajasthan & Ors. (S.B. Civil Writ Petition No.8179/2016), decided on 30 th August, 2017, which was subsequently affirmed by Bench of this Court in State of Rajasthan Vs. M/s Karni Mines & Minerals (D.B. Special Appeal (Writ) No.652/2018), decided on 3 rd May, 2018. However, a special leave petition preferred in the case of M/s Karni Mines & Minerals being Special Leave Petition (Civil Diary) No.33307/2018 was pending before the Honble Supreme Court. 4. Learned Additional Advocate General fairly submits that now the special leave petition in M/s Karni Mines & Minerals (supra) has been dismissed by the Honble Supreme Court and, therefore, the present special appeal deserves to be dismissed in the light of rejection of Special Leave Petition. 5. Dismissed accordingly. The application under Section 5 of the Limitation Act is disposed of.
