JUDGMENT 1. By this application u/s 438 Cr.P.C., the petitioner, namely, Kishor Choudhury has prayed for pre-arrest bail apprehending arrest in connection with Patacharkuchi P.S. Case No. 56/2020 u/s 326/307 of the IPC. 2. Heard Mr. B.K. Das, learned counsel for the petitioner and Mr. M.P. Goswami, learned Addl. Public Prosecutor for the State. 3. Allegation against the petitioner was that he inflicted injury to the informant by sharp weapon. 4. It is submitted by the learned counsel for the petitioner, Mr. Das that the wife of the petitioner lodged an FIR alleging that the informant assaulted her husband and as a counterblast to the said FIR, the present FIR has been lodged. 5. Case diary called for is received and perused, which shows materials substantiating the allegation made in the FIR. 6. Therefore, having regard to the incriminating materials in the case diary and the nature of accusation, this is not considered to be a fit case for extending the benefit of prearrest bail. Accordingly, the prayer for pre-arrest bail stands rejected. Send down the case diary. AB stands disposed of.
