JUDGMENT Vinit Kumar Mathur, J. - The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner who is in custody in connection with F.I.R. No.586/2019, Police Station Pratapnagar, District Udaipur for the offences under Sections 412, 414 & 120-B of IPC. 2. Heard learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record. 3. Learned counsel for the petitioner submits that the as per the information of the co-accused Devi Lal, an amount of Rs.2,80,000/- (Rupees: Two Lac Eighty Thousand Only) has been recovered. Devi Lal has already been enlarged on bail. Learned counsel for the petitioner further submits that except the recovery of Rs. 1,00,000/- (Rupees: One Lac only), there is no evidence on record to connect the present petitioner with the offence alleged in the present case. One of the known person of the petitioner called him to help the accused persons as their vehicle had broken down. The petitioner just helped the principal accused persons without knowing the fact that they looted the bank. He further submits that the petitioner was not aware of the fact that the amount of Rs. 1,00,000/- (Rupees: One Lac Only) was the same amount which was looted from the bank. The charge-sheet in the matter has been filed. The conclusion of trial will take sufficiently long time, therefore, it is prayed that the petitioner may be enlarged on bail. 4. The learned Public Prosecutor opposes the bail application. 5. Having regard to the facts and circumstances of the case and upon a consideration of the arguments advanced, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted. 6. Consequently, the present bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that the accused-petitioner Ummed Singh S/o Shri Nen Singh Kesariya arrested in connection with F.I.R. No.586/2019, Police Station Pratapnagar, District Udaipur shall be released on bail; provided he furnishes a personal bond of Rs.50,000/- (Rupees: Fifty Thousand Only) with two sureties of Rs.25,000/- (Rupees : Twenty Five Thousand Only) each to the satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
