JUDGMENT Arun Kumar Tyagi, J. (Oral) - The petitioner has filed the present (first) petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No. 135 dated 17.11.2019 registered under Sections 307, 324 and 506 read with Section 34 of the Indian Penal Code, 1860 (for short 'the IPC) and under Sections 25 and 27 of the Arms Act, 1959 at Police Station Mullanpur, District SAS Nagar. 2. Mr. Lalit Kumar, Advocate has appeared on behalf of the complainant and filed his power of attorney which is taken on record. 3. Learned Counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. The petitioner is alleged to have given kirch blow on the right flank of complainant-Jaswinder Singh which was declared to be simple. The injury which was declared to be dangerous to life is not attributed to him. The trial is likely to take long time. No useful purpose will be served by further detention of the petitioner in custody. 4. On the other hand, learned State Counsel and learned Counsel for the complainant have submitted that the petitioner actively participated in the crime, gave kirch blow on the right flank of the complainant and committed serious offences and does not deserve the concession of regular bail. 5. Keeping in view the facts and circumstances of the case, particularly that the petitioner is alleged to have inflicted blow on the right flank of Jaswinder Singh which injury was declared simple and injury declared to be dangerous to life is not attributed to the petitioner and also the fact that trial is likely to take long time but without commenting on merits, I am of the considered view that the petitioner deserves the concession of regular bail. 6. Therefore the petition is allowed and the petitioner is ordered to be released on regular bail on furnishing of personal and surety bonds by him to the satisfaction of the trial Court/Chief Judicial Magistrate/ Duty Magistrate concerned.
