JUDGMENT Ravindra Maithani, J. - Petitioners seek quashing of FIR No. 0801 of 2019, under Sections 498-A, 323, 504, 506 IPC and Section 3 r/w 4 of the Dowry Prohibition Act, 1961, PS Kotwali, Roorkee, District Haridwar, on the basis of amicable settlement arrived at between the parties. 2. This matter is heard through video conference 3. The FIR has been lodged by respondent no.3 with the allegations that after marriage with petitioner no. 1 Akash, she was harassed, abused and tortured for the demand of dowry. The FIR is quite in detail. Learned counsel for the petitioners would submit that the parties have amicable settled the dispute and have decided to stay separate and a suit has been filed to obtain a decree of divorce on the basis of mutual consent. 4. A joint compounding application has been filed by petitioner no.1, Akash who has been identified by Shri Aditya Pratap Singh, Advocate, and respondent no.3 Smt. Jyoti who has been identified by Shri Ravi Joshi, Advocate, along with affidavit of both the parties. 5. Petitioner no.1 Akash and Smt. Jyoti have joined this proceedings through video conferencing as identified by their respective learned counsel. Both the parties have told that they have amicably settled the disputes. It is a dispute arising out of matrimonial discord. Nothing would be obtained if the process is allowed to continue. Therefore, based on the amicable settlement between the parties, the FIR in question deserves to be quashed. 6. The petition is allowed. FIR No. 0801 of 2019, under Sections 498-A, 323, 504, 506 IPC, and Section 3 r/w 4 of the Dowry Prohibition Act, 1961, Police Station Kotwali Roorkee, District Haridwar is quashed on the basis of amicable settlement between the parties.
