ORDER : 1. Challenging the proceedings, dated 15.04.2020, issued by respondent Nos. 3 and 4 imposing penalty against the petitioner, this writ petition has been preferred. 2. While referring the impugned proceedings, it is fairly admitted before this Court by the learned counsel for the petitioner that the petitioner is having an efficacious alternative remedy of filing an appeal before the appellate authority. In that view of the matter, entertaining this writ petition would not be desirable. At this stage, the learned counsel for the petitioner has strenuously contended that in case impugned proceedings are not suspended till the filing of the appeal, the petitioner will suffer irreparably. It is further urged that the petitioner is ready to deposit the amount as specified in Para 3.11 of the Marketing Discipline Guidelines 2018. 3. In view of the aforesaid, we direct that if the petitioner prefers an appeal within one month from today and deposits the amount as per the aforesaid guidelines, till then no coercive steps be taken against the petitioner in pursuance of the impugned proceedings. It is further made clear that if the appeal is filed within the time as stipulated above, it shall be considered and decided by the competent authority within a period of six months from the date of filing of the appeal. 4. With the aforesaid directions, the Writ Petition is disposed of. 5. There shall be no order as to costs. As a sequel, all the pending miscellaneous applications shall stand closed.
