JUDGMENT Ravindra Maithani, J. - Petitioner challenges the order dated 21.02.2020 passed in Bail Application No. 106 of 2020, Parvez Khan @ Jafar Vs. State, passed by the Court of Sessions Judge, Nainital. 2. Heard learned counsel for the parties through video conferencing and perused the record. 3. Facts, necessary to resolve the controversy, briefly stated, are as hereunder; Petitioner was named accused in FIR No.37 of 2019 under Section 420 IPC, Police Station Bhimtal, District Nainital. He was arrested. It appears that on 06.03.2020, the Court enlarged him on short term bail, subject to payment of Rs.5 Lakhs to the informant. The Court in its order also categorically stated that if such payment is not made, the interim bail shall not be extended further. It appears that the petitioner did not pay the amount, as assured by him. On 21.08.2020, the Court considered all these factors and rejected the interim bail granted to the petitioner. This order dated 21.08.2020 is impugned herein. 4. Learned counsel for the petitioner would submit that due to lockdown, the petitioner could not make payment and he may be given time for such payment. 5. The interim bail was initially granted to the petitioner. He had assured that he would pay Rs.5 Lakhs to the informant. His interim bail was finally cancelled on 21.08.2020. The lockdown has been much eased for a long now, but, the petitioner did not pay even the part of the money, which he had assured before the Court to pay to the informant. Therefore, this Court is of the view that the learned Court below did not commit any error in rejecting the interim bail application of the petitioner and this petition has no force. It deserves dismissal. 6. The petition is dismissed.
