JUDGMENT 1. Heard Mr. Sreenu Garapati, learned counsel appearing on behalf of the petitioner. 2. Heard Mrs. Neetu Sinha, learned counsel appearing on behalf of the opposite party-Central Bureau of Investigation. 3. This petition has been filed for the following reliefs: - ''for quashing the Order dated 26-08-2019, whereby and whereunder the Learned Trial Court allowed the prayer of the prosecution to re-examine the prosecution witnesses under section 311 of Cr.P.C. in connection RC Case No.-6(A)/1997-D pending before the learned court of the Sri Ravi Ranjan Additional Sessions Judge-IV-cum-CBI, Dhanbad though the case record shows that the prosecution evidence closed on 13-03-2018 and the same is illegal and untenable in the eyes of law and further prays to pass such other order(s) deemed fit and proper in the present facts and circumstances of the case in the interest of justice;'' 4. Learned counsel for the petitioner seeks permission to withdraw this petition. He submits that withdrawal of this petition may not prejudice the case of the petitioner before the learned court below. 5. Learned counsel for the opposite party has no serious objection to the prayer made. 6. Permission for withdrawal of this petition is accorded. 7. Accordingly, this petition is hereby dismissed as withdrawn. 8. However, it is made clear that withdrawal of this petition will not prejudice the case of the petitioner before the learned court below in any manner. 9. Interim order, if any, stands vacated. 10. Pending interlocutory applications, if any, are also dismissed as not pressed. 11. Let a copy of this order be communicated to the learned court below through FAX.
