JUDGMENT 1. Heard Mr. F Haque, learned counsel for the petitioner and Mr. H Sarma, learned Addl. PP, Assam. 2. This is an application under Section 438 Cr.P.C. filed by the petitioner, namely, Md. Aijul Islam @ Ajijul Islam, praying for pre-arrest bail apprehending arrest in connection with Tezpur PS Case No.2348/2019 under sections 448/302/34 IPC (corresponding to GR Case No.4222/2019). 3. Perused the FIR and the documents annexed therewith. Also perused the case diary produced today. 4. The allegation made in the FIR was that the sister of the informant was given in marriage to the present petitioner and because of torture meted out to her, she was brought back and has been staying with her parents. On 27.11.2019, the petitioner along with his associates came to the house of the informant and demanded Rs.5,000/- from the parents of the informant and on their refusal the petitioner threatened them with dire consequences and on that night itself the parents of the informant were killed. 5. Having considered the gravity of the offence and the materials in the case diary as well as the nature of investigation required to be made this does not appears to be a fit case for extending the benefit of pre-arrest bail to the petitioner. 6. Accordingly the prayer for pre-arrest bail stands rejected. 7. The pre-arrest bail application stands disposed of. Send back the case diary.
