ORDER (Oral) Ali Mohammad Magrey J.—By medium of the instant petition; filed in the year 2002, the petitioner has craved the indulgence of this Court in granting him the following relief(s): “In the premises, it is, therefore, prayed that by issuance of an appropriate writ, order or direction preferably one in the nature of: — I. Mandamus, commanding the respondent No.4 to withdraw notification No. PSC/Ex-2001/64 dated 4-12-2001 and thereafter to issue the notification afresh wherein 2 posts should be reserved for physically handicapped category and accordingly the bifurcation of 50 posts have to be re-scheduled. II. Mandamus, commanding the respondent No. 2 & 3 to complete all the requisite formalities as provided by J&K Persons with Disabilities (Equal Opportunities Protection of Rights and Full Participation) Act, 1998 particularly Section 22 and Reservation Rules of 1994 as amended by SRO 41 of 2001, keeping in Annexure-B to this SRO and Circular dated 29-9-1998 and thereafter direct the respondent No.5 to fill up 2 posts among the physically handicapped persons who may apply under such category and for this purpose, the respondents may take any steps required including issuance of corrigendum to the order by which Registrar General had referred 50 posts to the Law Deptt, to be filled up by P.S.C. and accordingly, Law Department would also issue an amendment to their letter by which these posts were referred to respondent No.4. III. Mandamus, commanding the respondents to consider the petitioner against 2 posts reserved for handicapped persons, irrespective of the fact whether the requisite formalities are completed by 01-2-2002 or before the date of examination, i.e. March 2002. IV. Any other writ, order or direction which this Hon’ble Court may deem fit and proper under the facts and circumstances of the case be also passed in favour of the petitioner and against the respondents.” Today, when this matter was taken up for consideration, Mr B. A. Dar, the learned Senior Additional Advocate General, appearing on behalf of the respondents, submits that by efflux of time, the prayer made in the instant petition has turned infructuous in view of the fact that all the posts advertised in terms of the advertisement notice in question, being Notification No. PSC/Ex-2001/64 dated 4th of December, 2001, including the post(s) claimed by the petitioner in this petition, stand filled up strictly as per the recommendations made by the Jammu and Kashmir Public Service Commission.
It is further submitted that in fact the judicial Officers appointed in pursuance of the aforesaid advertisement notification have since been promoted to higher posts and that some of them have even retired from service on reaching the age of superannuation. The learned Senior Additional Advocate General, in this backdrop, contends that there, thus, is no scope for the petitioner to press for the relief prayed for in the instant petition almost 18 years ago. The petitioner, who is present in person before this Court through Virtual mode, does not dispute the aforesaid statement made by the learned Senior Additional Advocate General. In view of the above position obtaining in the matter, the instant petition is dismissed as having turned infructuous. Interim directions, if any, subsisting as on date shall stand vacated. This shall also dispose of any CM(s) pending alongwith this petition.
