JUDGMENT 1. Heard Ms. T Som, learned counsel for the accused-petitioner and Mr. B Sharma, learned Addl.P.P., Assam, appearing for the State respondent. 2. By this application filed under Section 439 Cr.P.C., the accused- petitioner, namely, Md. Jahidul Islam has prayed for granting bail, in connection with Hajo PS Case No. 165/ 2020 under Sections 379/506/34 of the IPC. 3. Case diary, as called for, is placed before the Court. 4. Perusal of the case diary reveals that the accused-petitioner was caught red-handed while committing the offence of theft of diesel oil from the Dumpers parked at Agyathuri village. Case diary reveals that the accused-petitioner has been thoroughly interrogated by police and no stolen property has been recovered out of his possession. The investigation has also progressed substantially. Therefore, this Court is of the considered opinion that if liberty of bail is granted to him, further investigation in the case is unlikely to be adversely affected. 5. Therefore it is provided that the accused-petitioner, namely, Md. Jahidul Islam, shall be released on furnishing bail bond of Rs.25,000/- with one surety of like amount to the satisfaction of the learned JMFC, Hajo, Kamrup, subject, of course, to the following conditions: 1. That the accused petitioner shall co-operate in the investigation as and when required; 2. That the accused-petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts either to the Court or to any police officer; and 3. That the accused-petitioner shall not commit any similar offence, of which he is accused, or suspected of commission. Return the case diary. With the above directions, the bail application stands disposed of. Let a copy of the order be issued under signatures of the Court Master.
