JUDGMENT 1. Sri Monoj Talukdar has filed this application for bail under Section 439 of the Code of Criminal Procedure, 1972 in Jagiroad P.S. Case No.139/2020 under Section 376AB of IPC read with Section 6 of POCSO Act and added Section 342 of IPC and read with Section 21(2) POCSO Act, 2012. 2. The Court proceedings have been conducted by means of creating a Virtual Court with the help of technology, so as to maintain distance between the staff, Advocates and the Presiding Judge. 3. I have heard Mr. P. Sharma, learned counsel for the applicant and Mr. NJ Dutta, learned Additional Public Prosecutor, Assam for the respondents. 4. Having gone through the contents of the FIR, I find that the accused, who violated the victim, a minor girl, would be the main accused. The accusation against the applicant being the owner and manager of the brick kiln is that he prevented aunty of the victim from taking help of law. 5. I have taken into account the instructions taken by the learned Additional Public Prosecutor in context of the role played by the applicant. I have also taken into account that the applicant has been in custody for more than 24 days. Further custody of the applicant shall not serve any purpose of investigation. False implication of the applicant, being the employer of the main accused cannot be ruled out at this stage. 6. Considering the totality of the facts and circumstances of the case, the application is allowed. 7. It is hereby directed that the applicant, namely Sri Monoj Talukdar be released on bail on his furnishing bail bonds to the satisfaction of the District and Sessions Judge, Morigaon. 8. Heavy surety. 9. It is further directed that in case the applicant approaches any witness or delays the trial, the prosecution would be at liberty to seek cancellation of bail of the applicant. 10. Let a copy of this order be provided under the signature of the Court Master.
