JUDGMENT 1. Sri Dilip Dutta has filed this application for bail under Section 439 of the Code of Criminal Procedure in Tingkhong PS Case No.42/2020 registered under Section 354-A of the IPC read with Section 10 of the POCSO Act, 2012. 2. The Court proceedings have been conducted by means of creating a Virtual Court with the help of technology, so as to maintain distance between the staff, Advocates and the Presiding Judge. 3. I have heard Mr. A Lal, learned counsel for the applicant and Mr. NJ Dutta, learned counsel for the prosecution. 4. As per the gist of the accusation, the applicant, a teacher, sexually harassed his pupil aged about 11 years. 5. Learned counsel for the prosecution has apprised the Court that investigation has already been concluded. Incriminating evidence has been found. Charge-sheet has been filed. 6. At this stage, learned counsel for the applicant contends that let this application be dismissed as withdrawn with liberty to the applicant to file an application for similar relief before the lower court after statement of the victim is recorded in course of trial. 7. Dismissed as withdrawn with liberty as prayed for. 8. Let copy of this order be provided under the signature of the Court Master.
