JUDGMENT N. S. Dhanik, J. - This criminal revision has been preferred by the revisionist challenging the order dated 18.02.2020 passed by the learned Principal Judge Family Court, Dehradun in Case No. 400 of 2019, "Smt. Preeti and another v. Sri Aditya Prakash Sharma" whereby a total interim maintenance of Rs. 10,000/- per month has been awarded in favour of the second respondent and Rs. 7,000/- per month has been awarded in favour of the third respondent herein. 2. Heard learned counsel for the parties. 3. Learned counsel for the private respondent has submitted that vide this Court's order dated 13.08.2020 passed in the present matter the amount of interim maintenance has been reduced from Rs. 17,000/- to Rs. 8,000/- per month which is too less for maintenance of respondent nos. 2 & 3. He further submits that the revisionist have enough sources to give higher amount of maintenance to respondent nos. 2 and 3. 4. On the other hand, learned counsel for the revisionist would submit that the interim maintenance as modified by this Court is sufficient and need no interference. The private respondents have not produced any sound proof regarding the income of revisionist before the Court below. 5. After arguing at some length, he limits his prayer only to the extent that the matter may kindly be remanded back to the lower Court for its expeditious disposal. 6. Considering the submissions advanced by the learned counsel for the parties, the present criminal revision is disposed of with the following directions: (i) The matter is remanded back to the learned Court below to decide the same without being prejudiced, as expeditiously as possible. (ii) Till the final disposal of the case by the Court below, the revisionist shall pay a sum of Rs. 12,000/- per month to the private respondents. However, the learned Court below shall be at liberty to either reduce or enhance the amount of maintenance after hearing learned counsel for both the parties. (iii) It is made clear that the revisionist shall pay arrears, if any, to the private respondent @ Rs. 8,000/- per month from 13.08.2020 till today i.e. 04.11.2020 and from 05.11.2020, the interim maintenance and arrears, if any, be paid @ 12,000/- per month. Needless to say that the interim maintenance modified herein would have no effect on the merits and the Court below is at liberty as given above. 7.
