JUDGMENT 1. Shri Moon Basumatary has filed this application for bail under Section 439 of the Code of Criminal Procedure, 1973 in Jengraimukh P.S. Case No. 1/2020 u/s 326/307 IPC. 2. The Court proceedings have been conducted by means of creating a Virtual Court with the help of technology, so as to maintain distance between the staff, Advocates and the Presiding Judge. 3. I have heard Mr. T. Deuri, learned counsel for the applicant and Mr. NJ Dutta, learned Additional Public Prosecutor, Assam for the respondent. 4. As per accusation in the FIR, applicant fired with his service pistol on Joydev Nath. 5. Learned counsel for the applicant has argued that it was an accidental fire. Joydev Nath alleged that the firearm had not been properly maintained by the applicant and, therefore, there was a verbal dispute. When the pistol was being cleaned for maintenance a bullet was fired. 6. Learned counsel for the prosecution has pointed out that the injured has already been discharged from the hospital. Although injury of simple nature has been found however, in view of technical definition, Section 326 IPC has been invoked. 7. Considering the fact that the applicant has been in custody since 1.1.2020 and the fact that further detention of the applicant shall not serve any purpose of law or investigation, as also the fact that the applicant is in police force and so is the victim, in peculiar facts and circumstances of the case, this application is allowed. 8. It is hereby directed that the applicant, namely Shri Moon Basumatary be released on bail on his furnishing bail bonds to the satisfaction of Chief Judicial Magistrate, Majuli. 9. Heavy surety. 10. It is further directed that in case the applicant approaches any witness or delays the trial, the prosecution would be at liberty to seek cancellation of bail of the applicant. 11.
