JUDGMENT 1. Mr. Manik Medhi has filed this application for bail under Section 439 of the Code of Criminal Procedure, 1973 in CID P.S. Case No.30/2019 registered under Sections 120B/121/121A/122/123/143/147/148/150/152/153/153A/326/333/353/427/436 of the Indian Penal Code read with Section 66 of IT Act, 2000 (Corresponding GR Case No.20298/2019). 2. The Court proceedings have been conducted by means of creating a Virtual Court with the help of technology, so as to maintain distance between the staff, Advocates and the Presiding Judge. 3. I have heard Mr. R. Hazarika, learned counsel for the applicant and Mr. NJ Dutta, learned Additional Public Prosecutor, Assam for the respondent. 4. The applicant has filed this application with the plea that the applicant has not been named in the FIR at issue. It has been pleaded that even if the applicant joined the protest/demonstration against the proposed legislation CAB and CAA, no offence as alleged has been committed. It is the right of every citizen to express himself through agitation. 5. Learned counsel for the prosecution has not been able to dispute that the applicant has not been named in the FIR at issue. It is further not in dispute that essentially it is the case of the prosecution that the applicant engaged in raising a protest against CAB and CAA. 6. Considering the rival contentions and also the fact that further custody of the applicant shall be of no use for the purpose of investigation, the application is allowed. 7. It is hereby directed that the applicant be released on bail on his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate, Kamrup (Metro) at Guwahati. 8. It is further directed that in case the applicant approaches any witness or delays the trial, the prosecution would be at liberty to seek cancellation of bail of the applicant. 9. Let a copy of this order be provided under the signature of the Court Master.
