JUDGMENT Ravi Malimath, A.C.J. - This writ petition is filed in public interest seeking for the following reliefs:- "(a) Issue a writ, order or direction in the nature of mandamus to the respondent no.1 for the continue functioning of Nautha/Buransi Punjab national bank, in Tehsil Pauri, District Pauri garhwal as mentioned in (Annexure No.1) to this P.I.L. writ petition. (b) Issue a writ, order or direction in the nature of mandamus directing to the respondents no. 1,2,3,4 to stop any further process regarding the merging of Nautha/Buransiu Punjab national bank into Bharsar Punjab national bank, in Tehsil Pauri garhwal till the disposal of this writ petition. (c) Issue a writ, order or direction in the nature as this Hon'ble Court may deem fit and proper in the Circumstances of the case. (d) Award the cost of the Petitioner." 2. The plea of the petitioner is that the functioning of the bank is required for the local villagers; and the closure of the bank has led to the miscarriage of justice. 3. On a query by the Member of Parliament (Lok Sabha), a reply has been furnished by the general manager of the bank which reads as follows:- General Services Administration Division Head Office, Plot No.4 Sector 10, Dwarika, New Delhi December 30, 2017 Maj. Gen. B.C. Khanduri (Retd) Honble Member of Parliament (Lok Sabha) 136-A, Parliament House Annexe NEW DELHI 110001 REG: Merger of BO : Buransi (Nautha) with BO: Bharsar Respected Sir, Please refer your letter No. 04/17 dated 18.12.2017 requesting therein not to merge Nautha Branch with BO: Bharsar in view of Public interest. The matter was taken up with our Haridwar Circle it has been informed as under: 1. The Nautha Branch was opened on March 2013 and is having only a business of Rs. 1.89 Crores as on date 2. The branch is incurring losses since its inception. 3. State Bank of India is having its branch named Sainj at a distance of 2.25 kms. And catering the needs of people of nearby villages. 4. Nautha branch is working for 2 days in a week from the old location apart from one BC location which is looking after the banking needs of the villagers. It is informed to all the customers that in case of their outsized banking needs, they may contact BO: Bharsar. And catering the needs of people of nearby villages. 4. Therefore, the same indicates the reasons as to why the bank has decided to merge the Nautha branch with the Branch Office at Bharsar. The reasons assigned are cogent and acceptable. It is not for the Court to determine as to which exact location a bank must be situated. Moreover, substantial reasons have been offered by the bank for the closure. 5. Under these circumstances, we do not find any ground to entertain this writ petition. Therefore, the writ petition is dismissed.
