JUDGMENT 1. By this application under Section 439 CrPC, petitioner, namely, Manoj Talukdar @ Monoj Talukdar, who was arrested on 26.04.2020, has prayed for granting him regular bail, in connection with Chhaygaon PS Case No. 293/2020, under Sections 294/333/353/427/506/34 IPC. 2. Heard the submissions of learned counsel for both the parties. It has been submitted that though the present petitioner was not named in the FIR, but he was subsequently arrested on the ground that they abetted the commission of the offence and tried to disobey the police officials. By producing the bail order of the co-accused dated 05.05.2020, passed in Bail Application No. 970/2020, it has been contended that as the co-accused who was also arrested and forwarded by the same forwarding letter, has been granted bail by this Court, so, the present petitioner being similarly situated, should be granted the privilege of bail. 3. Considered the documents annexed, including the forwarding letter and the bail order dated 05.05.2020, referred into as well as the FIR. 4. Obviously, in the present case, the informant is a Police Officer, who has named 3 persons, who have obstructed him in doing his duty and has also assaulted him. 5. The present petitioner was not in any way named in the FIR and in that case, the petitioner was not involved in causing injury to the informant to attract the offence. 6. Ground of forwarding appears to be abated, meaning thereby, he may be a person of the locality, who was present in the place of occurrence. 7. Considering all entirety of the matter and also the fact that the accused is not named in the FIR and being similarly situated with the other co-accused released, he is hereby allowed to go on bail of Rs. 20,000.00, with one surety of the like amount, to the satisfaction of learned CJM, Kamrup at Amingaon, in connection with the aforesaid case. 8. Bail Application stands disposed of.
