JUDGMENT 1. Heard Mr. B Choudhury, learned counsel for the accused petitioner and Mr. NJ Dutta, learned Additional Public Prosecutor, Assam, appearing for the State respondent. 2. By this application filed under Section 439 Cr.P.C., the accused petitioner, namely, Deep Paul has prayed for granting bail in connection with Boko PS Case No. 265/2020 ( GR No. 299(K)/2020) under Sections 447/354 of the IPC R/w Section 8 of the POCSO Act. 3. It is jointly submitted by the learned counsel for both the sides that the statutory period of detention of the accused petitioner is over. 4. The FIR dated 10.03.2020 shows that the accused petitioner, who went to the house of the informant with intention to put colour, sexually abused his minor daughter. 5. The forwarding report of the accused petitioner shows that he has been in judicial custody since 11.03.2020. The forwarding report also shows that the victim stated in her statement that the accused had hugged her and pressed her breast. 6. In view of the above and as it has been submitted that the investigation is yet to be completed, it is provided that the accused-petitioner namely, Deep Paul, shall be released on furnishing bail bond of Rs.20,000/- with one surety of like amount to the satisfaction of the learned Special Judge (POCSO Act), Kamrup, Assam, subject, of course, to the following conditions: 1. That the accused petitioner shall co-operate in the investigation, as and when required; 2. That the accused petitioner shall not hamper or tamper with the investigation in any manner; 3. That the accused petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts either to the Court or to any police officer. 7. With the above directions, the bail application stands disposed of.
