JUDGMENT 1. Heard Mr. R Kalita, learned counsel for the accused petitioner and Mr. N.K. Kalita, learned Additional Public Prosecutor, Assam, appearing for the State respondent. 2. By this application filed under Section 439 Cr.P.C., the accused petitioner, namely, Khirod Choudhury has prayed for granting bail in connection with Chhaygaon PS Case No. 293/2020 under Sections 294/307/333/353/427/506/34 of the IPC. 3. Mr. R Kalita, learned counsel for the accused petitioner, submits that the incident occurred due to a road traffic accident and despite being innocent, he has been languishing in jail since 25.04.2020. There is no ingredient against the petitioner attracting offence under Section 307 of the IPC. 4. Mr. N.K. Kalita, learned Addl. P.P. submits that the incident related to a quarrel that took place out of a motorcycle involved in an accident. 5. The injury report shows injuries caused by hand blows. The investigation has substantially progressed. Therefore, this Court finds that in the backdrop of facts of the incident, further detention of the accused petitioner may not be necessary in the interest of ongoing investigation. 6. Therefore, it is provided that the accused petitioner namely, Khirod Choudhury, shall be released on furnishing bail bond of Rs.20,000/- with one surety of like amount to the satisfaction of the learned CJM, Kamrup, Amingaon. 7. With the above directions, the bail application stands disposed of.
