JUDGMENT Jasgurpreet Singh Puri, J. (Oral) - The present petition has been filed under Section 439 of the Code of Criminal Procedure (for short the 'Cr.P.C.'), for the grant of interim bail in FIR No.208 dated 07.07.2018, under Section 15, 61, 85 of the Narcotic Drugs and Psychotropic Substances Act, registered at Police Station, Bhuna, District Fatehabad, Haryana. 2. Learned counsel for the petitioner has submitted that in the present case wife of the petitioner is to undergo gynae surgery tomorrow i.e. on 8.2.2020 at Maharaja Aggarsen Medical College and Hospital, Agroh, District Hisar and has further pleaded that since it is a major surgery, petitioner's support in the present case would be necessary and prays for grant of interim bail in the present case. 3. On 6.2.2020, this Court had directed the State counsel to seek instructions from the concerned officials with regard to the factum of surgery, if any, which is to be conducted upon the wife of the petitioner namely Manju, on 8.2.2020 at the above said Hospital and also with regard to the conduct of the petitioner. 4. Learned State counsel, on instructions from SI Kashmir Singh, states that surgery, in fact, is to be conducted on 8.2.2020 at the above said hospital. He further submits that there is nothing adverse against the petitioner so far as his conduct is concerned. 5. I have heard the learned counsel for the parties and in view of above, I am of the considered opinion that the present case is a fit case, particularly in view of the stand taken by the learned state counsel, to grant the concession of interim bail to the petitioner. 6. Accordingly, the petition for the grant of interim bail is allowed. The period of interim bail to the petitioner will start on 08.2.2020 from 10:00 A.M. till 4:00 P.M. on 12.02.2020 at which time the petitioner will surrender before the Jail Authorities. The petitioner will be released on interim bail for the above said period subject to his furnishing bail bond/surety bond to the satisfaction of the learned trial Court/Duty Magistrate. A copy of the order be given dasti to the learned counsel for the petitioner as well as the learned State counsel under the signatures of Bench Secretary.
