JUDGMENT 1. Heard Mr. AM Khan, learned counsel appearing for the petitioner and Ms. SH Borah, learned Additional Public Prosecutor for the State of Assam. 2. By this petition under Section 438 Cr.P.C., the petitioner, namely, 1.Md. Samer Ali has prayed for granting him pre-arrest bail, apprehending arrest in connection with Agia PS Case No. 254/2019 under Sections 143/353/338/333/307 of the IPC read with section 13/14 of the Assam Gambling and Betting Act. 3. The case diary, as called for, is placed before the Court. 4. Mr. AM Khan, learned counsel for the petitioner, submits that the informant, who was running an illegal gambling at Balbala was vehemently opposed by the petitioner and he reported the aforesaid act of the informant to the S.P., Goalpara and the O.C., agaia P.S. but the police stood against him and filed the instant false case. 5. Ms. SH Borah, learned Addl.P.P. submits that the injury report reveals sustainment of grievous injury caused by blunt weapon to the injured police personal. Ms. Bora further submits that there is abundance of incriminating evidence against the petitioner. 6. The FIR reveals the allegation of assaulting on police personal on duty by the petitioner and others, who went to stop illegal gambling. 7. Scrutiny of the evidence including the injury report, so far collected by the investigating officer, reveals prima facie incriminating evidence against the petitioner and therefore, this Court finds it not a fit case to grant the privilege of pre-arrest bail to the petitioner. 8. Accordingly, the pre-arrest bail application stands rejected. 9. Return the case diary. 10. This disposes of the pre-arrest bail application.
