JUDGMENT 1. Heard Mr. H.R.A. Choudhury, learned Sr. counsel for the petitioner. Also heard Mr. B.J. Dutta, learned Addl. P.P., Assam appearing for the State respondent. 2. This petition under Section 438 Cr.P.C., is filed for granting the privilege of pre-arrest bail to the petitioner, namely Mohibul Hoque @ Mohibul Hussain, apprehending arrest in connection with Dhubri P.S. Case No. 1384/2019 registered u/s 143/341/325/427/153A/379/506 of the IPC. 3. The case diary, as called for, is placed before the Court. 4. Mr. H.R.A. Choudhury, learned Sr. counsel appearing for the petitioner, submits that the petitioner is falsely accused in the case. Mr. Choudhury further submits that there occurred only a simple incident of hot exchange of words between the complainant party and some other people, which was only witnessed by him, who is a businessman. According to Mr. Choudhury, in the backdrop of the facts and circumstances of the case, custodial interrogation of the petitioner may not be necessary and he undertakes to co-operate in investigation. 5. Mr. B.J. Dutta, learned Addl. P.P., submits that the case diary reveals incriminating material against the petitioner. 6. The F.I.R., inter-alia, reveals that when the informant and 12 brothers and friends were returning home after a pilgrimage to Mahamaya Bathing Ghat, Dhubri, the petitioner along with others abused them with filthy language and assaulted them giving rise to enmity between two communities. 7. Injury reports show that two injured persons sustained multiple simple and grievous injuries caused by blunt objects. 8. On scrutiny of the case diary, it prima facie transpires incriminating material against the petitioner. This Court, in the backdrop of the detail facts and circumstances of the incident finds that it is not a fit case to grant the privilege of pre-arrest bail to the petitioner. 9. Accordingly, the pre-arrest bail application stands rejected.
