JUDGMENT Cheekati Manavendranath Roy, J. - This petition is filed under Section 438 of the Code of Criminal Procedure, 1973, to enlarge the petitioners on bail in the event of their arrest. 2. The petitioners are accused Nos.1 and 2 in Crime No.159 of 2020 of Anaparthi Police Station, East Godavari District. 3. The offences registered against them are under Sections 307, 384, 170, 188 r/w.34 of IPC. 4. Briefly stated, it is the case of the prosecution that on 27.06.2020 midnight the de facto complainant brought one vehicle load of grain and corn from Bhadrachalam and parked the said vehicle near his house. On the morning of 28.06.2020 accused Nos.1 to 4 contacted him over phone projecting themselves as officials of Vigilance Department and accused Nos.1 and 2 threatened the de facto complainant that they will cause damage to his image and demanded Rs.50,000/-. Out of fear, the de facto complainant admitted to give Rs.10,000/-. Accused Nos.3 and 4 also joined accused Nos.1 and 2. Projecting themselves as officials of Vigilance Department, they demanded the de facto complainant to give Rs.1.00 Lakh and when he did not agree for the same, accused Nos.1 to 4 grew-wild and accused No.1 attacked the de facto complainant with a knife and stabbed him in the stomach and escaped from the scene of offence. Accused Nos.2 to 4 also ran away and escaped from the scene of offence. The de facto complainant sustained stab injury on right side of his stomach. Therefore, the petitioners have committed the aforesaid offences. 5. Heard learned counsel for petitioners and learned Additional Public Prosecutor for the respondent-State. 6. Perused the record. 7. Having regard to the seriousness of the allegations, as it is a case where the de facto complainant was deliberately stabbed in the stomach with a knife by accused No.1, which clearly makes out a prima facie case of attempt to commit murder punishable under Section 307 of IPC and having regard to the deliberate attempt made by the petitioners in extracting money from the de facto complainant projecting themselves as officials of the Vigilance Department, this Court is of the considered view that this is not a fit case for grant of anticipatory bail to the petitioners. 8. Therefore, the Criminal Petition is dismissed.
