JUDGMENT M. Venkata Ramana, J. - Heard Sri N.V.R.Amarnath, learned counsel for the petitioner and learned Assistant Government Pleader representing learned Government Pleader for Services-III. 2. The petitioner was a Secondary Grade Teacher in M.P.P.S. Neelavaram, Duvvur Mandal. He was an accused in C.C.No. 240 of 2013 and C.C.No. 241 of 2013 on the file the Court of the Judicial First Class Magistrate, Badvel. He was convicted in C.C.No. 240 of 2013 and sentenced to undergo imprisonment for an offence under Section 498-A IPC. It appears that the petitioner was placed under suspension and later he was dismissed from service on account of his conviction and consequent imprisonment. 3. Later on, the petitioner preferred Crl.A.No. 34 of 2018 on the file of the Court of the learned Judge, Family Court, Kadapa, and by judgment dated 06.05.2019, the conviction and sentence so imposed against him were set aside. 4. It is the contention of the petitioner that he had already made a representation on 30.08.2019 to the respondents - authorities for reinstatement and it has not received required attention. Now, he has filed this writ petition questioning the inaction on the part of the respondents and in failing to reinstate him to service. 5. Sri N.V.R.Amarnath, learned counsel for the petitioner referring to the above facts and circumstances requests to direct the respondents - authorities to do needful particularly, the 2nd respondent inasmuch as what was impediment that prevented the petitioner to continue in service is now wiped out, and therefore, there cannot be any reason for the 2nd respondent from issuing necessary orders. 6. Learned Assistant Government Pleader representing learned Government Pleader for Services-III contends that the representation given by the petitioner was long ago and in the event a fresh representation is made to the 2nd respondent, it would receive appropriate attention. 7. In the above circumstances, it is desirable to apply the course suggested by the learned Assistant Government Pleader and to which Sri N.V.R.Amarnath, learned counsel for the petitioner, has also agreed. 8. 7. Therefore, in the above circumstances, this writ petition is disposed of with a direction to the petitioner to present a fresh representation to the 2nd respondent marking a copy to the 3rd respondent within two weeks from now and upon receiving the representation from the petitioner, the 2nd respondent is directed to dispose of the same strictly in accordance with law and extant rules within four weeks therefrom. The representation submitted by the petitioner as stated above, shall be acknowledged by the 2nd respondent. No costs. 9. As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
