JUDGMENT Cheekati Manavendranath Roy, J. - This petition is filed under Section 439 of the Code of Criminal Procedure, 1973, to enlarge the petitioner on bail. 2. The petitioner is A-1 in Crime No.354 of 2020 of Gannavaram Police Station, Krishna District. 3. The offences registered against her are under Sections 8(c) r/w 20(b)(ii)(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "N.D.P.S. Act"). 4. It is the case of the prosecution that on 08.06.2020, the petitioner along with other accused was found to be illegally transporting huge quantity of 246 kgs of Ganja in two cars bearing registration No. AP 05 CJ 1235 and AP 31 DB 5259 and at that time, they were apprehended by the police and the contraband was seized from their possession. Therefore, the petitioner has committed the aforesaid offences along with other accused. 5. Heard learned counsel for the petitioner and the learned Additional Public Prosecutor. 6. The contraband involved in this case is a huge quantity of 246 kgs, which is a commercial quantity. Therefore, the bar under Section 37 of the N.D.P.S. Act applies to the present facts of the case. There is nothing on record to indicate that the petitioner is not guilty of commission of the aforesaid offences. On the other hand, the record reveals that the accusation made against the petitioner is prima facie well founded. Investigation in this case is still pending. Therefore, the petitioner is not entitled to bail at this stage. Although it is stated by the learned counsel for the petitioner that the petitioner has been suffering from HIV ailment, the petitioner is at liberty to take it to the notice of the Superintendent of Jail where she is lodged, for the purpose of providing medical treatment to her. 7. In the result, the Criminal Petition is dismissed.
