DINESH MEHTA, INDRAJIT MAHANTY

body2020
JUDGMENT 1. Heard learned counsel for the petitioners. 2. Prayer in the present writ petition has been made to cancel an auction of a river Khari in the District Bhilwara for excavation of sand. It is asserted that if excavation of sand is permitted by the leasee, it is likely to have adverse impact on the adjoining khasras. 3. Learned counsel for the petitioners submits that auction of the lease had taken place on 03.03.2020. However, the petitioners are approaching this Court now. 4. Since the auction took place in the month of March, 2020 and we are now in the month of September, 2020, we are not inclined to entertain the present writ petition. However, we grant a further opportunity to the petitioners to make a representation before the District Collector, Bhilwara and if such representation is made, the same shall be considered on its own merit within a period of four weeks from the date of its receipt, keeping in view the contentions raised by the petitioners regarding likelihood of adverse impact on adjoining khasras. 5. Accordingly, the writ petition is disposed of with the aforesaid observations.
