KUMARI PRABHA SHARMA, SANDEEP MEHTA

body2020
JUDGMENT 1. Heard. Perused the material available on record. 2. The convict-petitioner who is undergoing life-term imprisonment at the Central Jail, Udaipur has approached this Court for assailing the recommendations drawn up by the District Parole Advisory Committee, Chittorgarh in its meeting held on 19.03.2020 whereby the convict-petitioner has been sanctioned second parole of thirty days upon furnishing personal bond in the sum of Rs.50,000/- and "two sureties in the like amount". 3. Shri K.R. Bhati, learned counsel representing the convictpetitioner submits that the financial status of the convict- petitioner is extremely poor and it shall be impossible for him to arrange for two surety bonds in terms of the recommendations dated 19.03.2020 and thus, he continues to languish in jail. Shri Abhishek PUrohit, Associate to Shri Farzand Ali, AAG has placed on record the family status report of the petitioner which confirms the fact that the petitioner's family condition is indeed very poor. 4. In this view of the matter and in order to ensure that the convict-petitioner is able to avail the benefit of second parole, we deem it fit to relax the conditions imposed upon him in the recommendations drawn up by the Committee in its meeting held on 19.03.2020. The petitioner shall now be released on second parole of thirty days upon furnishing a personal bond in the sum of Rs.80,000/- only. The requirement of furnishing two surety bonds in the sum of Rs.50,000/- each is waived. However, the other conditions are maintained. 5. The writ petition is allowed, accordingly.
