JUDGMENT Sangeet Lodha, J. - Heard learned counsel for the applicant and learned Public Prosecutor. 2. This bail application has been filed by the applicant under Section 439 Cr.P.C., who is facing trial for offence under Section 376 IPC before the Additional Sessions Judge No.1, Udaipur. 3. The first bail application preferred by the applicant being Bail Application No.15092/2019 was dismissed by this Court vide order dated 16.12.2019 as not pressed. 4. Learned counsel appearing for the applicant submits that the prosecutrix has already been examined by the trial court. She has turned hostile and not supported the prosecution story. 5. A perusal of the statement of the prosecutrix reveals that she has denied the factum of applicant committing rape upon her, rather she has stated that on account of non-payment of outstanding amount she had levelled allegation against the applicant of committing rape upon her. 6. This factual position is not disputed by the learned Public Prosecutor. 7. Having regard to the facts and circumstances of the case and without expressing any opinion on the merits of the case, this Court is of the opinion that the bail application filed by the applicant deserves to be accepted. 8. Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that applicant Gopilal @ Gopal Regar S/o Chatar Singh Regar, arrested in FIR No.139/2019 registered at Police Station- Mavli, District Udaipur, shall be released on bail; provided he executes personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
