JUDGMENT Pankaj Bhandari, J. - Petitioner has filed this bail application under Section 439 of Cr.P.C. 2. F.I.R. No.316/2019 was registered at Police Station Kaman, District Bharatpur for offence under Section 363 of I.P.C. lateron Police found Sections 363, 376 IPC and Section 3/4 of POCSO Act. 3. No ground is made out for entertaining the bail application as prosecutrix is a thirteen years old girl who has levelled allegation of rape against the petitioner in her statement recorded under Section 164 Cr.P.C. 4. Criminal Misc. Bail Application is accordingly dismissed. 5. However, petitioner would be free to move fresh bail application after recording of the statement of prosecutrix in the Court.
