JUDGMENT Sangeet Lodha, J. - This third bail application has been filed by the applicant under Section 439 Cr.P.C. 2. After investigation, the police has already filed charge sheet against inter-alia the applicant for offence under Section 419, 420, 467, 468, 471 & 120B of IPC. The matter is posted for charge arguments before the trial court since 15.02.2020. 3. It is submitted that on account of spread of COVID-19 pandemic, the accused applicant, who is lodged in Central Jail, Udaipur was not produced before the trial court and, therefore, charge arguments could not be heard. 4. Learned counsel for the applicant submits that co-accused, namely, Dilip Vaishnav and Vijay Singh have already been enlarged on bail vide orders dated 07.01.2020 and 15.01.2020 passed by this Court in Bail Applications No.93/2020 and 542/2020 respectively. It is submitted that the applicant is behind the bars since 04.11.2019. The offences alleged to have been committed by the applicant are triable by the Magistrate. That apart, it is submitted that one Siddharth Agarwal, in whose favour sale-deed was executed, has also been enlarged on bail and the property transferred already stands restored to the original owner, Pahad Singh. 5. Having regard to the facts and circumstances of the case and without expressing any opinion on the merits of the case, this Court is of the opinion that the bail application filed by the applicant deserves to be accepted. 6. Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that applicant Pahad Singh S/o Kesar Singh @ Logar Singh, arrested in FIR No.277/2019 registered at Police Station- Ambamata, District Udaipur, shall be released on bail; provided he executes personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
