ORDER : Rongon Mukhopadhyay, J. 1. Heard Mr. Rahul Dev, learned counsel for the petitioner and Mr. Arun Kr. Pandey, learned A.P.P. for the State. 2. Petitioner has prayed for grant of anticipatory bail, as he is apprehending his arrest in connection with Dhansar P.S. Case No. 102 of 2019. 3. It has been alleged that the petitioner had eloped with the wife of the informant on 18.08.2019 along with jewellery worth Rs. 5,00,000/- and Rs. 50,000/- in cash. 4. In the statement of the victim recorded under Section 164 Cr.P.C. she has stated that the petitioner had induced her to go to Bengaluru on the pretext of providing her a job. She was later on taken to Mumbai. In Bengaluru the petitioner used to bring food from outside and after having food she used to become unconscious. On regaining unconsciousness she used to feel that something wrong has been done to her. She has further stated that the jewellery she had taken was with her. 5. It appears from the First Information Report as well as the 164 Cr.P.C. statement of the victim that she had left her husband and son to be with the petitioner. If the petitioner had offered to provide her with a job there was no necessity for the victim to have taken all her jewellery along with her. It, therefore, appears that the victim is a consenting party and appeared to have eloped willingly. 6. In such circumstances, therefore, I am inclined to extend the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner, named above, is directed to surrender in the court below within a period of four weeks from today and on such surrender, he shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each st to the satisfaction of learned Judicial Magistrate, 1 Class, Dhanbad, in connection with Dhansar P.S. Case No. 102 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. 7. This application stands allowed.
