JUDGMENT K.Lakshman, J. - This application is filed seeking anticipatory bail. Petitioner is accused in Crime No.281 of 2020 of Shankerpally Police Station, Cyberabad District. The offence alleged against the petitioner is under Section 304 Part-II IPC. 2. Sri P.Ravi Shankar, learned counsel for the petitioner, would submit that the petitioner is a student. Police instead of registering the crime under Section 304-B IPC, they have registered crime under Section 304 Part-II IPC. The ingredients of Section 304 Part-II are lacking as per the contents of complaint dt.04-07-2020. With the said contentions, he sought to enlarge the petitioner on anticipatory bail. 3. On the other hand, learned Public Prosecutor would oppose the said contentions and submit that the petitioner drove the vehicle in a high speed in a rash and negligent manner and caused the accident. He was in drunken condition. Due to the same, a person died on the spot. 4. On perusal of the contents of the complaint dt.04-07-2020, the petitioner drove the vehicle in a high speed in a rash and negligent manner and caused the accident. He left the vehicle there and fled away. In the said accident, a person died on the spot. Considering the said aspects, this petition is disposed of directing the petitioner to surrender before the Court below within two weeks from today and move regular bail application. The court below shall dispose of the said bail application on merits. 5. Accordingly, the Criminal Petition is disposed of. 6. Miscellaneous petitions, if any, pending in this criminal petition, shall stand closed.
