JUDGMENT Cheekati Manavendranath Roy, J. - This petition is filed under Section 439 of the Code of Criminal Procedure, 1973, to enlarge the petitioners on bail. 2. The petitioners are A-1 and A-2 in Crime No.1829 of 2020 of Anakapalli Town Police Station, Visakhapatnam District. 3. The offences registered against the petitioners in the above crime are under Sections 20(b)(ii)(C) r/w 8(c) of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short "N.D.P.S. Act"). 4. It is the case of the prosecution that on 04.07.2020, the petitioners, who are A-1 and A-2, are found to be illegally transporting 43 kgs of Ganja in a van bearing registration No.TN 43Z 8246 and at that time, they were apprehended by the police and the contraband was seized from their possession. Therefore, they have committed the aforesaid offences. 5. Heard learned counsel for the petitioners and the learned Additional Public Prosecutor. 6. The contraband involved in this case is 43 kgs which is a commercial quantity. Therefore, the bar under Section 37 of the N.D.P.S. Act applies to the present facts of the case. There is nothing to indicate on record that the petitioners are not guilty of commission of the aforesaid offences. It is contended by the learned counsel for the petitioners that the persons who actually secured the Ganja is A-4 and A-5 and they engaged the services of the petitioners for transportation of the said Ganja by paying remuneration to them and as such it is A-4 and A-5 who are the main culprits responsible for transportation of the said Ganja. Even so, as the petitioners have deliberately transported the said Ganja knowing fully well regarding the culpability of illegally transporting the same, the petitioners are guilty of illegal transportation of the said Ganja. Investigation in this case is still pending. Therefore, the petitioners are not entitled to bail at this stage. 7. In the result, the Criminal Petition is dismissed.
