JUDGMENT K. Lakshman, J. - This is an application for anticipatory bail. The petitioner is the sole accused in Crime No.82 of 2020 of Prohibition & Excise Police Station, Zaheerabad, Sangareddy District. The offence alleged against the petitioner is under Section 8(b) read with Section 20(a) and 20(b) (i) of NDPS Act. 2. Heard Sri Palle Sriharinath, learned counsel for the petitioner and learned Assistant Public Prosecutor. 3. Learned counsel for the petitioner would submit that the petitioner has taken the land on lease and nothing is recovered from him. With the allegation that the petitioner is cultivating the ganja plants in the land, the officials of Prohibition and Excise have registered the present case against the petitioner. He sought anticipatory bail to the petitioner considering his health condition. 4. Learned Assistant Public Prosecutor has opposed the bail petition on the ground that the allegations levelled against the petitioner are punishable under various sections of NDPS Act and hence, anticipatory bail cannot be considered. 5. On perusal of the complaint, including the crime occurrence report, dated 25.08.2020, the allegations against the petitioner are that he is cultivating the ganja plants and the same were recovered from him. The offence alleged against the petitioner is under Section 8(b) read with Section 20(a) and 20(b) (i) of NDPS Act. 6. Considering the nature of allegations and the offences alleged against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. However, liberty is given to the petitioner to approach the Court concerned by moving a regular bail application by raising all the contentions raised in the present application including the health condition of the petitioner, that the petitioner is not the owner of the land and he is only cultivator by taking the land on lease. 7. Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, shall stand dismissed.
