JUDGMENT : Chandra Kumar Songara, J. 1. The instant appeal has been filed under Section 14-A S.C./S.T. (Prevention of Atrocities) Act, 1989 on behalf of the appellant, who is in custody in connection with F.I.R. No. 234/2020 registered at Police Station Lakhanpur, District Bharatpur for the offences punishable under Sections 143, 323, 341, 457, 336 and 376 of IPC and Section 3(1)(r)(s), 3(2)(V), 3(2)(Va) of SC/ST (Prevention of Atrocities) Act against the order dated 22/10/2020 passed by the Special Judge, SC/ST (Prevention of Atrocities) Cases, Bharatpur, whereby the bail application preferred under Section 439 Cr.P.C. on behalf of the appellant was rejected. 2. Learned counsel for the appellant has submitted that the victim is a matured girl and complainant has lodged the present case due to personal rivalry. Charge-sheet has already been filed. He further submitted that injured Sheela has got only simple injury and as per injury report of victim, no external injury seen and no injury seen on labia majora. Hence, appeal of the appellant may be granted. 3. Learned State counsel and counsel for the complainant both have strongly opposed the appeal. 4. Heard. Perused the material available on record. 5. Considering the submissions made by the learned counsel for the appellant and the facts and circumstances of the case but without expressing any opinion on merits/demerits of the case, this Court is of the opinion that the appellant deserves to be enlarged on bail. 6. Consequently, the instant appeal is allowed. The impugned order dated 22/10/2020 passed by the Special Judge, SC/ST (Prevention of Atrocities) Cases, Bharatpur is set aside. It is ordered that the accused-appellant, namely Ashok arrested in connection with aforesaid F.I.R. shall be released on bail; provided he furnishes a personal bond of Rs. 50,000/- with two sureties of Rs. 25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
