JUDGMENT Ravindra Maithani, J. (Oral) - The applicant Manoj Kumar Gangwar is in custody in F.I.R. No. 377 of 2018 under Sections 394 and 120-B of I.P.C. at Police Station-Kichha, District Udham Singh Nagar. The applicant has sought his release on bail. 2. Heard learned counsel for the parties and perused the records. 3. According to the F.I.R., on 28.11.2018, when informant was on his scooty going to his house, 2-3 unknown motorcycle-borne assailants way laid him and, at gun-point, looted Rs. 4.00 lakhs from him. 4. Mr. D.N. Sharma, learned counsel for the applicant, would submit that the co-accused, namely, Rahul has already been granted bail by this Court; and that there is no evidence against the applicant. 5. Mr. J.S. Virk, learned Assistant Government Advocate, would admit the fact that the co-accused, namely, Rahul has been granted bail by this Court. According to him the co-accused, when arrested, had taken the name of the present applicant as one of the accused. 6. Having considered the rival submissions, under the facts and circumstances of the case, this Court is of the view that the applicant deserves to be released on bail. 7. The bail application is, accordingly, allowed. 8. Let the applicant Manoj Kumar Gangwar be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
