JUDGMENT Cheekati Manavendranath Roy, J. - This Criminal Petition under Section 482 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") is filed seeking quash of the F.I.R. in Crime No.153 of 2020 of Bathili Police Station, Srikakulam District. 2. Heard learned counsel for the petitioner and the learned Additional Public Prosecutor. 3. The petitioner is A-1 in Crime No.153 of 2020 of Bathili Police Station, Srikakulam District. A case in the above crime was registered against the petitioner under Sections 270 and 273 of the Indian Penal Code, 1860 and under Sections 20(2) and 22(b) of the Cigarettes and Other Tobacco Products (Prohibition of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act, 2003. The said case is now under investigation. 4. Learned counsel for the petitioner would submit that this is a covered matter and this Court has earlier quashed the F.I.Rs registered for the similar offences based on identical facts. Therefore, he prayed for quash of the F.I.R. registered against the petitioner also. 5. Learned Additional Public Prosecutor also would concede that this is a covered matter in view of the earlier order passed by this Court and thereby prayed to pass appropriate order accordingly. 6. As can be seen from the copy of the order passed in Criminal Petition No.3003 of 2020 by this Court, it is obvious that this Court based on earlier orders of this Court passed in Criminal Petition No.5421 of 2019, quashed the F.I.R registered for the similar offences. 7. In view of the earlier orders of this Court and for the reasons stated therein, this Criminal Petition is allowed and the F.I.R registered against the petitioner in Crime No.153 of 2020 of Bathili Police Station, Srikakulam District, is hereby quashed. Miscellaneous Petitions, if any pending, in this Criminal Petition, shall stand closed.
