JUDGMENT Raj Mohan Singh. J. (Oral) - The petitioner seeks grant of anticipatory bail in case bearing FIR No.976 dated 24.11.2017 registered under Section 135 of Electricity Act, 2003 at Police Station Anti Power Theft, Bathinda, District Bathinda. 2. On 01.10.2019, following order was passed:- "Learned counsel for the petitioner contends that the case against the petitioner is totally concocted. The petitioner has been involved in the case only because he had been participating in the protest which the villagers had been carrying out against the Electricity Department. Otherwise, there is no evidence to show that the petitioner was indulging in the act alleged against him. Despite the incident of a day time, no independent witness was joined by the alleged raiding team. Itis also contended that there has been delay of 47 days in lodging the FIR. Otherwise also, the petitioner has already got installed the meter for the said electricity connection which is affixed in the street outside the house of the petitioner. Therefore, the petitioner has no reason or occasion to take a direct connection from the main line of the electricity. Notice of motion for 27.02.2020. Meanwhile, in the event of arrest, the petitioner be released on interim bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr. P. C." 3. It is not in dispute that the petitioner has joined the investigation and is not required for any further investigation of the case. 4. In view of above, order dated 01.10.2019 passed by the Coordinate Bench is made absolute, however petitioner shall abide by the conditions as envisaged under Section 438 (2) Cr.P.C. Petition stands disposed of.
