ORDER 1. The petitioner who is working as UDT has challenged the order dated 26.6.2020, whereby on revocation of the suspension order the petitioner has been transferred from Boda to Bhojpur. 2. Learned counsel appearing for the petitioner submits that the petitioner has no objection in going on transfer but he should be transferred to a nearby place. He has also submitted that the petitioner’s representation (Annexure P/4) is pending with a prayer to transfer him to a nearby place. 3. Learned counsel for the State has, on instructions, informed that the transferred place is only 85 k.m. away and it is not a far off place. 4. Having heard the learned counsel for the parties and on perusal of the record, it is noticed that on account of certain allegation of misconduct the petitioner was placed under suspension. The departmental enquiry against the petitioner under Rule 14(3) of the M.P. Civil Services (Classification, Control and Appeal) Rules, 1966 has also been instituted and the enquiry officer as well as the presenting officer have been appointed. In the aforesaid background though by theimpugned order the suspension of the petitioner has been revoked but having regard to the fact that the enquiry is to be conducted at Boda, the petitioner has been transferred from that place. The transferred place is only 85 k.m. away from the present place of posting. 5. In the aforesaid circumstances, I am of the opinion that no case is made out to interfere in the impugned transfer order. 6. Counsel for the State at this stage has submitted that there is no objection in deciding the petitioner’s representation but the petitioner should first join at the transferred place. 7. Considering the said submission, the petitioner is directed to join at the transferred place and the competent authority is also directed to thereafter decide the petitioner’s pending representation within a period of 2 months. Petition is accordingly disposed of.
