JUDGMENT K. Lakshman, J. - This is an application for anticipatory bail. The petitioner herein is accused No.1 in Crime No.109 of 2019 on the file of Police Station, Godhavarikhani Town-I, Peddapalli District. The offence alleged against the petitioner is under Section 306 r/w 34 IPC. 2. Heard Sri N.Ashok Kumar, learned counsel for the petitioner and learned Public Prosecutor. Perused the record. 3. The petitioner herein has filed Crl.P.No.6738 of 2019 seeking anticipatory bail and this Court has dismissed the same vide order dated 31.10.2019. There are overt acts/allegations against the petitioner herein. He has also filed Crl.P.No.4117 of 2020 seeking anticipatory bail and the same was dismissed on 22.09.2020. It is specifically stated in the said order that however, if the petitioner/A-1 surrenders before the competent Court within a period of 15 days from that date and applies for regular bail, the same shall be considered by the said Court in accordance with law. The petitioner failed to comply with the said order. He has filed second anticipatory bail application in Crl.P.No.4117 of 2020 and the same dismissed vide order dated 22.09.2020 on the ground that there are no change of circumstances and petitioner has not complied with the earlier order dated 31.10.2019 in Crl.P.No.6738 of 2019. 4. Learned counsel for the petitioner would submit that there is no abatement by the petitioner herein. The contents of the complaint, alteration memo and the notice lacks ingredients of Section 306 of IPC. Learned counsel would further submit that this Court has granted anticipatory bail to A-2 vide order dated 10.10.2019 in Crl.P.No.6318 of 2019. With the said submissions, learned counsel sought to consider the present application. 5. As stated above, there are specific overt acts against the petitioner herein. In the suicide note dated 09.08.2019, the name of the petitioner is mentioned and there are specific allegations against her. The earlier bail applications were dismissed with a direction to petitioner herein to surrender before the Court below which, he has not complied with. There are no change of circumstances from 22.09.2020 till date. 6. Considering the said aspects, this Court is not inclined to grant anticipatory bail to the petitioner herein in Crime No.109 of 2019. 7. Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions pending, if any, shall stand disposed of.
